Shia LaBeouf is facing an additional charge stemming from his recent New Orleans arrest.

According to The Associated Press, the 39-year-old actor was taken back into custody on Saturday, February 28th and hit with an extra misdemeanor count of simple battery related to the incident that resulted in his February 17th booking during a Mardi Gras celebration. LaBeouf posted the required $5,000 bond and was released from custody.

Back on the 17th, LaBeouf got into an alleged altercation at the Royal Street Inn & R Bar in New Orleans. In a police report, an accuser said he was “struck in his face with a closed fist, causing his nose to possibly dislocate.” The actor was also accused of using a derogatory slur for gay people multiple times.

LaBeouf was ordered to undergo substance abuse treatment, get drug tested, and post a $100,000 bond per the conditions for his release.

In an interview with YouTuber Andrew Callaghan of Channel 5 over the weekend, LaBeouf addressed his feelings about going to rehab. “My behavior… I gotta deal with that. Does that mean I gotta go to rehab again? I’m just not into it, bro,” he said. “I don’t think my answers are there. I don’t. I really, genuinely, don’t. If I genuinely did, I’d go. I don’t think I have a drinking problem.” Instead, LaBeouf claimed he suffers from “small man complex.”

He also told Callaghan that the altercation that led to his arrest stemmed from three gay men allegedly touching his leg. “I’ll be honest with you, big gay people are scary to me,” he said. “I’m like, standing by myself and three gay dudes are next to me, touching my leg, I get scared. I’m sorry if that’s homophobic. Then I’m that.”
